Individuals with family law matters before the B.C. provincial court now have an additional option to court thanks to a free mediation service.
The service was begun in 2012 at the B.C. Supreme Court by Vancouver lawyer Dinyar Marzban, and is now managed by Jane Reid of Jenkins Marzban Logan LLP, and has 23 lawyers who are certified mediators.

JML Family lawyers Dinyar Marzban Q.C., Scott Booth, Jane Reid, Kelsey Beazer and Samantha Simpson were all presenters at the Federation of Law Societies National Family Law Program. The Program was held July 9-12, 2018 in Vancouver, B.C. and was attended by approximately 575 lawyers, judges, and academics from across Canada. Dinyar, Kelsey and Samantha presented a paper regarding courts’ treatment of parental alienation in cases across Canada. Jane and Scott presented a paper on spousal support reviews in Canada.

Dinyar Marzban has been re-appointed to the Legal Services Society Board of Directors by the Law Society of B.C. for a further 3 year term.
In September and November 2017, Jane Reid was a speaker at Pacific Business & Law Institute conferences. In September, she spoke at the Family Law in 2017: Doing Things Differently to Benefit Families conference. Jane spoke on excluded property issues and presented a paper authored by Scott Booth and Kimberley Santerre. In November, Jane spoke at the Tax and Succession Planning for the Family Business conference where she spoke on protecting family businesses in spousal relationships and presented a paper she authored on the topic.
Dinyar Marzban, Q.C. and Scott Booth were both speakers at the 11th Biennial Family Law Conference for B.C. July 6 and 7, 2017. This two day conference brought together family lawyers from across the province to discuss significant legal changes, emerging trends, and current issues in family law. Leading lawyers were invited to speak and present papers at the conference. Dinyar presented on ethical issues affecting family lawyers. Scott Booth spoke on excluded property issues and presented a paper co-authored with JML lawyer Kimberley Santerre.
In Q.P. v. Q.N., the BC Supreme Court awarded primary residence of the parties’ 4 year old and final decision-making power to our client. Johanna Stein also argued convincingly that income should be imputed to the father for being underemployed and obtained an order for retroactive child support.

Kimberley Santerre, Lara Branson and Clare Funston updated the chapters in the Continuing Legal Education Society of BC’s Sourcebook related to Property, Injunctive Relief, and Evidence.
Bill Veenstra and David Claassen were co-counsel in a dispute over the existence of a lease and right of first refusal on behalf of a developer. We were successful in obtaining a declaration that the lease had expired and the tenant did not have a right of first refusal. In addition, we obtained damages against the tenant corporation and the principal of the corporation of $2,200,000 for interference with economic relations in International Sausage House Ltd. v. Hammer, 2015 BCSC 1155.

Battle of the Bar Bands, June 7, 2013
A fun event, for a good cause, this year’s Battle of the Bar Bands featured John Logan performing with the award winning cover band “Standard of Hair” at the Commodore Ballroom, on Friday, June 7.
Though they did not win, “Standard of Hair” along with every other band helped raise over $145,000 for the CBA BC Benevolent Society.

Don Thompson updated and revised the builders lien Practice Materials currently being used for the PLTC (Bar Admission) course, as well as the Solicitors Negligence chapter of the CLE (Continuing Legal Education) Builders Liens Practice Manual.

On April 20, 2013, Jamie Wood was delighted to attend the BC Association of Abattoirs & BC Association of Cattle Feeders 2013 Annual Convention & Trade Show as a keynote speaker. Jamie discussed the impact of the new Family Law Act on succession planning in a presentation entitled “Families Planning for Change.”
Mike Demers has been invited to speak at the Public Construction Council of British Columbia’s upcoming forum on the Risks and Liabilities of Green Building. The Southern Interior Construction Association is putting on its Construction 101 course for new industry participants and Mike Demers will be instructing the construction law components of the course. BC Hydro is in the process of rolling out a new standard form contract document. BC Hydro, together with the BCCA, ICBA and the BC Roadbuilders are conducting a series of meetings to explain the new document and to inform contractors on upcoming business opportunities on BC Hydro projects. Mike Demers and Bill Veenstra have been asked to speak at these meetings, providing contractors with the information they need to know in order to navigate the new contracts. This is a must-attend event if you are planning to do work with BC Hydro in the future. The first two events are scheduled for Vancouver (April 25th at 8:30 a.m.) and Kelowna (May 1st at 8:30 a.m.) Future conferences are planned for Vancouver Island and Northern BC. She presented “Lifting the Corporate Veil: Income Determinations for Shareholders, Directors and Officers Under Section 18 of the Federal Child Support Guidelines”, a paper that was originally authored by her and Dinyar Marzban for a National Judicial Institute Conference held in Toronto in February 2012 and subsequently published in Volume 31.1 of Canadian Family Law Quarterly.

On July 16, 2012, Dinyar Marzban and Jamie Wood presented a paper they authored entitled “Lump Sum Spousal Support – Refining A Blunt Instrument” at the Federation of Law Societies of Canada’s 2012 National Family Law Program in Halifax, Nova Scotia.
In June 2012, an article authored by Dinyar Marzban and Jamie Wood entitled, “Lifting the Corporate Veil: Income Determinations for Shareholders, Directors and Officers Under Section 18 of the Federal Child Support Guidelines” was published in Volume 31.1 of Canadian Family Law Quarterly. Dinyar and Jamie originally authored this article as a paper that Dinyar presented at the National Judicial Institute Conference in Toronto, Ontario in February 2012.

Dinyar Marzban has been appointed Chair of the provincial branch of the American College of Trial Lawyers. He is one of only two family lawyers in B.C. who have been admitted to the College.
On May 10, 2011, Jenkins Marzban Logan LLP hosted its’ biennial Construction Law Update at the Hilton Hotel in Burnaby. The two different construction management forms of agreement reflect the development of the construction management concept in the industry, distinguishing between the traditional “Owner’s Agent” approach (the CCDC 5A form) and the increasingly common “Construction Manager at Risk” approach (the CCDC 5B form). As of July 1, 2010, a new set of Rules of Court will apply to Supreme Court proceedings in British Columbia. The new Rules will have a significant effect on litigation in this province and will apply to ongoing litigation commenced prior to July 1, 2010. Angela Santoro joined the JML family law group in March 2009. Angela obtained degrees in commerce and law at Queen’s University. She was called to the bar of British Columbia in 2006 and was practicing at Hunter Litigation Chambers in Vancouver.
Scott Booth has become the firm’s newest partner, effective January 1, 2009. Scott joined JML in 1999 and is a member of the family law group. He is a past chair of the Canadian Bar Association’s Vancouver chapter of the Family Law Section and is a member of the editorial board of the Family Law Sourcebook for British Columbia.
